Terms of Service

1. Agreement to Terms

By accessing or using PairPerks, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.

2. Eligibility & Age Verification

You must be at least 18 years old and a currently enrolled student or verified affiliate of a supported university to use this Service. By providing your birthdate during registration, you certify under penalty of perjury that you are at least 18 years old. Any false statement of age is a violation of these Terms and may result in account termination and legal consequences.

3. The Matching Service

PairPerks provides a matching algorithm and exclusive VIP codes. We use demographic information (including ethnicity) as an input to our matching algorithm to facilitate user preferences. We do not guarantee that you will find a romantic partner, nor do we guarantee the accuracy or compatibility of any match. Like all algorithmic systems, our matching algorithm may contain biases, errors, or produce unexpected results. We make no representations about the mathematical fairness of the algorithm or its ability to satisfy all user preferences.

4. Safety & Conduct

• Zero Tolerance: Harassment, hate speech, or illegal behavior during dates or communications facilitated by PairPerks will result in an immediate and permanent ban.
• No Background Checks: PairPerks does not conduct criminal background checks, identity verification beyond university enrollment confirmation, or any investigation into the history or character of users. You cannot rely on PairPerks to identify dangerous, dishonest, or otherwise undesirable users. You are solely responsible for evaluating the trustworthiness and safety of other users.
• User Responsibility: You are solely responsible for your interactions with other users and for taking reasonable precautions in all interactions with other users, particularly if you decide to meet offline or in person. Meet in public places, tell a trusted friend where you're going, and use standard dating safety practices.

5. Limitation of Liability

To the fullest extent permitted by law, PairPerks LLC, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages resulting from:

• (A) Your access to or use of the Service;
• (B) Any conduct or content of any third party on the Service;
• (C) Any unauthorized access, use, or alteration of your transmissions or content;
• (D) Any bodily injury, emotional distress, or other damages arising out of or relating to communications or meetings with other users.

This limitation does not apply to claims arising from PairPerks' gross negligence, willful misconduct, or violation of applicable law.

6. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (A) your violation of these Terms; (B) your violation of any applicable law; (C) your use of the Service in an unauthorized manner; or (D) Content you create, submit, or share on the Service. This indemnification obligation does not apply to claims arising from PairPerks' gross negligence or willful misconduct.

7. Equal Opportunity & Non-Discrimination

While PairPerks allows users to specify demographic preferences in matching, we are committed to providing equal opportunities and not discriminating based on protected characteristics. Demographic data is used to facilitate user preferences in matching, not to exclude or deny service. Any evidence of discriminatory conduct or harassment will result in immediate account termination.

8. Third-Party Services & Merchant Partners

PairPerks may partner with merchants and third-party services. We are not responsible for the conduct, policies, or practices of any third-party applications, merchants, or services linked to or accessed through PairPerks.

9. Data & FERPA

By providing your university email address, you consent to PairPerks verifying your enrollment status with your university. We comply with the Family Educational Rights and Privacy Act (FERPA) and do not treat user data as educational records. Your educational institution is not responsible for PairPerks' privacy practices.

10. Your Rights & California Privacy

If you are a California resident, you have the right to: (A) access the personal information we collect about you; (B) request deletion of your personal information; (C) opt-out of the sharing or sale of your information; and (D) non-discrimination for exercising your privacy rights. 11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
